Summary Judgment Granted to Lynch Schwab Client in Commercial Litigation Matter

 

On October 19, 2009 Lynch Schwab obtained summary judgment for its client, an oil distributor in a breach of contract action. The distributor claimed that a purchaser had failed to pay for oil purchased over the course of several years. The Court found that since the distributor provided regular invoices detailing the amount of oil supplied and its cost, summary judgment was granted on the breach of contract claim. The owner of the defendant corporation had also personally guaranteed the debt of his company, and the Court also granted summary judgment to the distributor seeking to enforce the terms of the personal guaranty against the owner individually.
